United States K1 Immigrant Visa

The K1 immigrant visa allows prospect couples to meet in the US to perform the matrimonial ceremony. The visa holder will be approved a K1 visa so that they can marry the US citizen as soon as possible or within 90 days of arriving in the US. It is for the fiancée or fiancé of a U.S. citizen to enter the United States. This visa allows the foreign national to enter the United States legally in order to marry and apply for permanent residence. This is also called K fiancé visa.

Who Is It For

A K1 fiancé visa is one of the well-known US immigrant visa issued to the fiancé or fiancée of a US citizen to enter the United States.

How to Qualify?

There are certain eligibility requirements for K1 Visa. All individuals may not be eligible. The following basic requirements must be fulfilled by the applicant to get fiancé visa in the USA:

  • You must have strong evidence of your relationship
  • You are committed to marry while you are in the US on a K1 visa.
  • The marriage will be documented according to the US laws where the marriage will be done.
  • You and the US citizen must have at least one meeting in the past two years

If you do not fulfill these requirements, you could be informed that you are not eligible for the K1 Visa.

  • Following factors will make you ineligible quite instantly:
  • Criminal activities in the past (ex. drug trafficking).
  • Falsified or fraudulent documents.
  • You were banned from the U.S. or you overstayed in the U.S.

The U.S. citizen who is the sponsoring spouse of the applicant must also fulfil the requirements:

  • You must be a U.S. citizen.
  • You plan to marry the foreign citizen within 90 days of them entering the US.
  • Any earlier marriages that you or your fiancé have had are legally dismissed.

Process

To apply for a K1 visa, you must follow these following steps:

File Petition for Alien Fiance

The US citizen will first require permission from USCIS for the foreign citizen fiancé to visit in the US. When the petition reaches USCIS, the visa or embassy officials will go through it and examine all the evidences of the relationship, whether the parties genuinely intend to get married. If both the US citizen and the foreign citizen fiancé satisfy the requirements, then USCIS will accept the petition and send it to the National Visa Center (NVC).

Apply for the K1 visa

You can jump to complete your K1 visa application after the approval of Form I-129F. This needs to be done by the foreign citizen in a US Embassy or Consulate in their country of residence.

Complete Form DS-160

Complete the Form DS-160, Online Nonimmigrant Visa Application is used for US nonimmigrant visas and for the K1 visa as well.

Schedule the US Fiance visa interview

The visa interview might be conducted if you are between 14 and 79 years old. To complete the interview, you must first schedule it online.

Complete medical examinations

The U.S. immigrant visa requires you to go through a medical examination. Medical examination must be done at the designated points or panel physician’s clinic.

Compile your K1 visa document file

  • Two copies recent US visa photographs

Attend visa interview

If the embassy officer finds any sort of contradictory statements, he or she might not be satisfied to approve your application.

Government Fees

Presently, the fee for a U.S. citizen or long term permanent resident to submit Form I-130 on behalf of their sibling is $535.

After the petition is approved, the application fee for a family preference visa is $325. This fee is paid per application.

Additional Information

The K1 visa processing time may be longer. The USCIS does not give a definite length of processing time for the K1 visa.
