United States EB-3 Visa For Professionals, Skilled Workers and Unskilled Workers

To apply for the EB-3 visa, applicant must have an approved Immigrant Petition for Alien Worker, Form I-140, filed by the potential employer in the US. Workers normally require labor certification approved by the Department of Labor (DOL). Professionals, Skilled Workers and Unskilled Workers (Other Workers) obtain 28.6 percent of the annual international limit of employment-based immigrant visas. The EB-3 requirements are less strict compared to other categories, but the processing time may be longer than usual. Unlike persons with extraordinary abilities in the EB-1 category, EB-3 applicants need a sponsoring employer.

Who Is It For

There are three subgroups within this category:

Skilled workers: Individuals whose jobs require at least 2 years full time work experience.

Professionals: The members of the professions whose jobs require a minimum bachelors degree from a U.S. institute or its equivalent academic degree.

Unskilled workers (Other workers): Individuals that are able to fill up positions that require less than two years of full-time work experience

How to Qualify?

EB 3 Visa Eligibility:

Several immigrant visa categories are based on employment. Your degree, skills and job experience are some of the aspects used to determine if you are eligible for a specific type of employment-based visa.

Skilled Workers

  • You are required to show at least two years of full-time job experience or training. A relevant post-secondary degree may be considered as training;
  • You must be executing work for which eligible workers are not available in the US.
  • A labor certification and a full-time job offer are required.

Professionals

  • You must have a U.S. bachelor’s degree (or its foreign degree) relevant to the job, and that this degree is the normal requirement for entry into the job you are doing.
  • You must be executing work for which qualified workers are not available in the United States; and
  • A labor certification and full-time job offer are essential.

Unskilled Workers (Other Workers)

  • You must be doing full time unskilled labor, for which qualified workers are not available in the US; and
  • A labor certification and full-time job offer are essential.

Process

How to File An Application For EB-3 Visa USA?

Your employer must:

  • Review the guideline for Form I-140
  • Complete and sign Form I-140;
  • Pay the proper application fee, if applicable; and
  • Submit all required supporting documents

After You File

  • Once USCIS receive your Form I-140, we will process your petition, and you will receive a:
  • Receipt from USCIS regarding your petition;
  • Biometric services notice, if applicable;
  • Notice to attend an interview
  • Notice of our decision.

Documents Needed

Basic documents may include:

  • Passport(s) valid for at least six months beyond the intended date of entry into the United States,
  • Form DS-260, Immigrant Visa and Alien Registration Application.
  • Preview a sample DS-260 (6.4MB).
  • Two (2) 2×2 photographs. Read the required photo format explained in Photograph Requirements.
  • Civil Documents for the applicant.  The consular officer in the US embassy may ask for more information at the time of visa interview. Bring your genuine civil documents that includes ID documents, birth and marriage certificates, as well as legible photocopies of the genuine civil documents, and any required translations to your immigrant visa interview. Original documents and translations can then be given back to you.
  • Financial Support – At your immigrant visa interview, you must show documents to the consular officer that you are not likely to become a public charge in the United States.
  • Completed Medical Examination Forms – These are issued by the panel physician when you have successfully completed your medical and vaccination.

Government Fees

The EB-3 visa application fee is $460.

Other costs include medical test and, if applicable, vaccinations; translations and notary public; fees for getting supporting documents such as passport, police clearance, birth certificates, etc.

Additional Information

EB-3 visa cases may take long time as they are in numerically limited visa categories. The processing time varies from case to case and cannot be foretold for specific cases with any accuracy.

Family of EB-3 Visa Holders

If your I-140 petition is accepted, your spouse and depended children (must be unmarried) under the age of 21 may be eligible to apply for admission to the United States in E34 or EW4 and E35 or EW5.
